本文对贿赂犯罪中的主要罪名受贿罪、利用影响力受贿罪进行了重点研析,探讨新形势下关于贿赂犯罪在司法实践中如何运用.我国刑法理论根据立法的相关规定及司法实践的需要,从更有力于打击和遏制犯罪出发,对受贿罪的犯罪构成进行了深入而有益的探讨,取得了丰硕的成果,为刑法对受贿罪的补充、修正和完善提供了理论支持.改革开放以来,随着经济体制和政治体制改革的不断深化,经济发展水平有了较大的提高,所有制结构、经营管理体制及经济活动的主体都发生了巨大变化.传统意义上的贿赂犯罪在主体、客体、对象、行为方式诸方面发生了重大变化,出现了很多司法实践中难以操作处断的问题,并由此引发了刑事法律的修订.

This article makes key analysis on crime of accepting bribe and crime of accepting bribe by influenc ,the main accusations of bribery crime,discusses how to make it in use in judicial practice.China's criminal law theory,according to some regurlations on legislation and the demands of judicial practice,from the perspective of making for defeating and controling crimes ,carries out deep and beneficial discuss on the formation of crime of accepting bribe ,and have made great achivements,providing theory backup for the supplement,modification and perfection of this crime in criminal law.
Since the reform and opening up, along with the deepening of the reform of economic system and political system, the level of economic development has greatly improved, the ownership structure, management system and the main participators of economic activities have changed greatly. The bribery crime in traditional opinion has changed a lot on the aspact of subject, object, target, the behavior way,and so on，some problems difficult to solve in judicial practice have appearred, leading to the revision of the criminal law.
