[内容摘要]:情事变更原则是一直被视为对“契约严守”的相对突破,在德国表现为“法律行为基础制度”,法国表现为“不预见理论”,英美法系国家通过“合同落空理论”加以规制.作为一项重要原则,其在2009年我国《中华人们共和国合同法解释二》第二十六条中明确规定,但在适用中应明确其适用法律要件,辨析其与周边法律制度之关系,从而最终确定其适用的法律效果.
